Disability Law

In America, disability law prohibits private employers, state and local governments, government agencies, and labor unions from discriminating against anyone that as a disability. This means that employers are forced to offer an equal opportunity employment situation for all considered to be employed. Disability laws give the government the right to check in on companies, and make sure they are following the law by implanting this type of work environment.

The disability law in this country clearly defines its definition of what it means to be disabled. It labels a disability as someone that has an impairment or limitation of some sort. It states the need for record of such disabilities as well. An employee that is considered qualified will have a disabilities that will not interfere with the job at hand, and will not need much accommodating. An employer is required to accommodate an employee to a certain point including; installing equipment that is helpful to a disabled person, and restructuring a job to suite such an employee. If something like this will require a lot of money or time away from the actual job, than an employer will not have to accommodate a disabled person.

Disability Laws protect children is school also. They ensure that children are not treated differently or not educated properly because they are disabled. Many times children that suffer from ADD attention deficit disorder or ADHA are considered to be problematic. Schools that do not take the time to connect and figure out what curriculum is best for the child will suffer much deserved consequences from local, state, and national governments.

In America, disability law requires all public entities to comply with the rules and regulations of the act. They require all public entities, to install public entries to buildings, special parking spots etc… In terms of public transportation, buses, airplanes, trains, subways, ect … are required to make seating available to those with disabilities and to create set rates of which they have to follow. Disability laws require set rates so that they can protect disabled people that may be on a set income, or receiving public assistance. Disability law in the United States also requires that telecommunications follow a set of regulations when dealing with disabled people. This is mostly for those that are deaf, or cannot speak properly. Disability laws require that all fifty states be equipped with TRS or telecommunications relay services. Most of the time these calls can be done over the Internet instead of at home. Disability laws place pressure on society to change some of the every day situations that seem very easy for a person who is not disabled into suitable situations for those that do.

Many times organizations don’t implement provisions in a buildings structure or its operations until its is necessary to do so. The disability law has made it a requirement that any business or organization whether private or public, have accommodations for potentially disabled people. The worst thing that can happen is for someone to feel as though they are not welcome because something is wrong with them.
