Discrimination has been a problem in America since this country was first established. The Pilgrims discriminated against the Native Americans when they first settled in this country, and before there was even a word to describe their actions. Discriminations are defined as the unfair treatment of a person or group due to prejudice. A prejudice is some preconceived notion, belief, or judgment of a group based on race, gender, sex, origin, class, or disability. Many times discriminations arise out of fear that another race or people will take over or interfere with the flow of things. When African Americans were enslaved in the United States, it was important to keep them ignorant so that they could not get the potential somehow to become equal or better than those enslaving them. When African Americans finally got the opportunity to be free they were subsequently the race that was apart of the poor class in this country, and started off ignorant, making three reasons to be the receivers of discriminations. Control becomes another reason why discrimination exist across the globe and even in a country like the United States where “everyone” is supposed to be equal. People naturally like to have control, and or have power forcing them to oppress others that are not like them. The idea that more than one type of people can share power is very idealistic. For example, women were the receivers of discrimination for much of American history. The idea was that men worked and women were to stay home and obey their husbands, cook, clean, and bare children. This gave men the power to control everything that happened in the country, and left women voiceless. When this began to change women were not allowed to work certain jobs, and were not respected if they chose to work at all. This discrimination mad it hard for women to feel equal to men ever since. Recently, the power structure has stabilized and begun to equal out, however women still face discriminations in the work place, at home, and in public. Discriminations based on sexual orientation also exist in the United States currently and have moved to the forefront of Civil rights issues in this country. Many people that are of the gay or lesbian culture are not allowed the same opportunities in relation or finances.

For example, two people of the same sex are not allowed to marry, or receive marital benefits in the United States. Many people see these discriminations as unconstitutional and contradictory. Others believe that union of two people should only exist between a man and a woman based off of the religious definition of it. However, the constitution clearly prohibits discrimination based on religious premise and therefore would make the gay marriage issue contradictory. This is the current power struggle in America that is again, at the root, based off of fear. Many people do not understand how this lifestyle can work in a place like America. Discrimination occurs when people do not know what else to do to combat a shift in the established way of life. Whether it has to do with race, sex, religion, disability, origin, or sexual orientation, it is wrong.

Discrimination in the United States has existed since the country first formed. The pilgrims discriminated on the Indians, before there was a word to describe their actions. Whites discriminated against blacks since this country has inhabited both at the same time. Many people still feel that discrimination still exists, they are probably right.

However, the shift from blacks has moved to Indians, or people of Arabic decent. This of course is due to the events of nine eleven in the United States, however it is wrong. The United States even has a history of discrimination against women, and that’s of any race.
Although there are laws that prohibit discrimination against anyone based on race, religion, sex, origin, or even disability, discrimination cases still are prevalent in American society. It is almost like when telling a child not to do something, but the do it anyway just to go against the grain.

A race discrimination case focuses on a particular party using ones color or ethnicity to discriminate against them. These discrimination cases have existed since way back in the sixties and still occur today in the twenty first century when we have an African American president of the United States. For example, in two thousand and nine, JCPenny was sued because they fired a greeter at their Long Island store for race related reasons and was sued by the EEOC or the Equal Employment Opportunity Commission in a discrimination case for the firing. The EEOC is a government agency that is used in discrimination cases of any kind that come out of the work place.

This is a situation that highlights how quickly a case like this can turn into race relations. Many times discrimination cases will establish systems to protect the employees and make sure that they are not discriminated against for any reason. A discrimination case that are religion based usually have the backing of some congregation or church. In the United States there is not one set race, making it against the law to prohibit a certain religion, or impose a certain religion on another. Religion is an issue that is very sensitive for many and can cause people to do some unlawful things. Just because another person does not have the same beliefs as another, does not make it right to discriminate against them. A discrimination case has been filed against the United States supreme court many times as of late regarding gay marriage. Seeing as there is not one set religion in the United States, and marriage is defined as being between a man and a women from a religious stand point, gay people a problem with this restriction as law. Discrimination cases of this kind won in the state of Massachusetts where civil unions were created and amended into the Constitution of the state. A discrimination case protects all people regardless of what they’re lifestyle maybe, and the Constitution where most of these rights are stated, was designed to do that as well. More importantly, the whole belief of America is based on constitutional law, both state and local.

Disability discrimination laws are put in place to protect those that do not have the same skill set as a “normal person. Now, a disability can be anyone with a physical or mental impairment. This impairment must prevent a person from doing one or more things effectively. The disability can be physical, cognitive, sensory, or learning. Disability discrimination laws specifically state that a person is qualified for the job if they can perform all duties asked of them. If they can not than then, and only then can an employer refuse to employ them. If a person feels that they can perform the task at hand, but that they still received unequal treatment, then the disability discrimination law has been broken. According to the disability discrimination law, a person is entitled to equal opportunities regardless of any impairment they may have. Now if a person needs something the government calls reasonable accommodations, and are able to perform the tasks that the job requires, then they must be equally considered for the position. Reasonable accommodations under the disability discrimination law include, making adjustments to equipment and training material, changing a work schedule, making the location accessible to all with disabilities, and keeping production at the same level. Now, if an employer must spend more money than necessary, or decrease production and hence, lose money, then they are not required to higher that disabled person. Disability discrimination laws protect the disabled to the best level they can. When someone is not able to function like a “normal” person, than it is hard to allow them to perform tasks that are difficult or challenging. In many cases simple tasks to someone without a disability, are very hard to someone with a disability. In the case of initial consideration for a job, the employer cannot question the ability or disability status of an individual for any reason. Required medical exams must be used for job purposes only and may not ever interfere with the initial employment process. Additionally, according to the disability discrimination laws, people using drugs to help them with there disability on a legal basis may not be questioned. This protects the individual from releasing unnecessary information to an employer.

Many times people that have disabilities are turned away from a job in certain industries because they do not fit a specific look, or would interfere with the current look of the company. Too many business try to fit a mold and will not break it for someone that is a burden on them anyway. The disability discrimination law stops employees who hire someone that is disabled just to say they did it and give them some busy work to perform. In this economy employers are no longer over staffing, and are requiring serious experience for a job. With the power to make their own requirements for a position, disability discrimination laws like the Civil Rights Act, can only help a the disabled so much. Many of the disabled are out of work and forced to collect government assistance.

In America the discrimination act is a piece of legislation used to protect human rights. The United States is a melting pot of different races, genders, and types of people. People of all kinds are allowed the opportunity to work and can not be discriminated against.

Discrimination acts protect women, African Americans and other minorities, people disabilities, and people who may be pregnant. These laws basically prohibit any business, agency, or government entity from discriminating on any person, for any reason. The idea is for everyone to be created equal and awarded the same opportunities. Equality is a huge factor in everything that goes on in the United States. Now, while the government can not prevent individuals from forming their own biases or discriminating in their personal lives, they can regulate businesses, and employers.

Women’s rights are fairly new in America when compared to other rights established in the constitution. For a while in history, women were not allowed to work in industries that men do, and when they were allowed, they received unequal pay. Discrimination acts protect these women and ensure that they are allowed to work. The discrimination act also had a provision added to it that allowed women to receive equal pay for their services. Ever since the discrimination acts were put into play, women have become increasingly successful in the workplace. African Americans and minorities had a similar problem in American history, where they were discriminated against. Discrimination acts protect more than employment opportunities, they also protect people from being treated differently on a daily basis. Until the Civil Rights movement, African Americans were not allowed to eat, learn, ride, or even use the restrooms with Caucasian Americans. The discrimination act prevents these events from happening by making them unlawful and unconstitutional. People who have disabilities are often treated differently and closed off from certain opportunities. Sometimes they are not allowed to work in certain places based of there disability. Discrimination acts prevent this from occurring. Additionally, places that are not equipped with accommodations for handicap or disabled people are closing them off and making them feel unwelcome.

Discrimination acts make this illegal and require all businesses to accommodate them . In the workplace the discrimination act requires employers to set up certain training programs that accommodate people with disabilities of all kinds, and protect their rights so that they can not be fired. The same goes for pregnant women, in that an employer cannot refuse to hire a woman because she is newly pregnant. She gets a fair and equal opportunity to work. Equal opportunity employment is a huge part of the discrimination act in America, because too many times people place their own biases into their businesses. A discrimination act in American has become essential because this is the land of the free, making it a melting pot for all races. For anyone to discriminate against another because they are different will be going against what is the essence of the American dream. The constitution protects and enforces discrimination acts as well as the rights for every individual.

In America, disability law prohibits private employers, state and local governments, government agencies, and labor unions from discriminating against anyone that as a disability. This means that employers are forced to offer an equal opportunity employment situation for all considered to be employed. Disability laws give the government the right to check in on companies, and make sure they are following the law by implanting this type of work environment.

The disability law in this country clearly defines its definition of what it means to be disabled. It labels a disability as someone that has an impairment or limitation of some sort. It states the need for record of such disabilities as well. An employee that is considered qualified will have a disabilities that will not interfere with the job at hand, and will not need much accommodating. An employer is required to accommodate an employee to a certain point including; installing equipment that is helpful to a disabled person, and restructuring a job to suite such an employee. If something like this will require a lot of money or time away from the actual job, than an employer will not have to accommodate a disabled person.

Disability Laws protect children is school also. They ensure that children are not treated differently or not educated properly because they are disabled. Many times children that suffer from ADD attention deficit disorder or ADHA are considered to be problematic. Schools that do not take the time to connect and figure out what curriculum is best for the child will suffer much deserved consequences from local, state, and national governments.

In America, disability law requires all public entities to comply with the rules and regulations of the act. They require all public entities, to install public entries to buildings, special parking spots etc… In terms of public transportation, buses, airplanes, trains, subways, ect … are required to make seating available to those with disabilities and to create set rates of which they have to follow. Disability laws require set rates so that they can protect disabled people that may be on a set income, or receiving public assistance. Disability law in the United States also requires that telecommunications follow a set of regulations when dealing with disabled people. This is mostly for those that are deaf, or cannot speak properly. Disability laws require that all fifty states be equipped with TRS or telecommunications relay services. Most of the time these calls can be done over the Internet instead of at home. Disability laws place pressure on society to change some of the every day situations that seem very easy for a person who is not disabled into suitable situations for those that do.

Many times organizations don’t implement provisions in a buildings structure or its operations until its is necessary to do so. The disability law has made it a requirement that any business or organization whether private or public, have accommodations for potentially disabled people. The worst thing that can happen is for someone to feel as though they are not welcome because something is wrong with them.

People that are disabled are often looked at like they are less than or incapable of functioning. The common misconception about the disabled is that every disability is noticeably. While is this half true, many disabled people have physical disabilities that can be easily noticed. However, there are other disabilities that people can have, that are not noticeable, which gives them the leeway to lead pretty normal and even extravagant lives. Many famous people from the past and the present have been disabled and still managed to be successful in life. Some of them have had physical disabilities, and others have had more sensory, cognitive, or health related disabilities.

Albert Einstein was disabled until the age of three. He had a condition that prevented him from speaking a word until he was this age. He went on to become one of the most intelligent of his time, and any time for that matter. His inventions and theories have enabled mankind to progress in more ways then one. Christopher Reeve, best known for playing superman, was crippled after a horse riding injury and was disabled for the rest of his life. Even while suffering from paralysis, he managed to help others overcome hardship relating to disabilities by becoming an advocate for medical research.
Sarah Bernhardt was a French actress who became disabled when she suffered a knee injury. She remained an actress and continued to perform on stage with one leg up until the day she died. She proves that disabled people can do anything despite their conditions.

Robin Williams is one of he disabled people that suffered from ADHD. He never used medication for it, and instead focused his energy to acting. ADHD is attention deficit disorder, and can be very distracting in a classroom setting and as an actor. Tom Cruise, another notable actor, suffers from dyslexia and still manages to read scripts. He, like Mr. Williams, never gave up. These are examples of how someone tackled their disability head on instead of being fearful of it. These two issues are dealt with on a daily basis. Remembering a script can be hard for anyone and a actor with disabilities especially.

Other disabled people that are famous include; her who has dyslexia, Alexander Graham Bell who had a learning disability, Helen Keller who was blind, deaf, and mute, George Washington who had a learning disability and could not write, and Ludwig van Beethoven who was deaf. All of these famous individuals have done many great things in their careers being disabled and all. Many people had no idea that some of these people had these problems. Being disabled doesn’t have to mean a life without striving for ones goals in life. Disabled people find new and innovative ways to communicate, interact, and remain active in society. Just because someone can walk, or speak, or hear, doesn’t mean that they can’t follow their dreams. Like many of these famous individuals, normal everyday folks engage in their favorite activities, and do what ever they want to do in life.

A disability is when someone is impaired, has limitations, and or restrictions. Now this term is very broad and covers a wide range of different issues. People with disabilities are never exactly alike, they have many characteristics. Sometimes a person with a disability may very well look like they have a something wrong with them. Other times a person may have a hidden disability and look perfectly normal. Many types of disabilities exist such as, cognitive physical, sensory, psychiatric and health related. Physical disabilities usually force people to use special equipment like wheelchairs, canes, or prosthetics. People with these types of conditions may have trouble moving around or taking care of themselves, but are perfectly normal otherwise. Many times ramps are built to assist with physical activities at businesses. When it comes to driving, if the person still has the ability to drive handicap decals are usually given to keep them closest to entrances and things of that nature. Special team building exercises exist like basketball, and even volleyball for people with this type of injury. Sensory disabilities are those that effect one or more of the five senses. For example, blindness, deafness, or even paralysis. With these conditions someone’s way of life changes, and can be a lot difficult to manage. These conditions are more noticeable and can be very challenging. Many organizations exist to provide support and equipment for these conditions on both a national, and state level.

An invisible disability is a psychiatric impairment of some kind. These conditions can include bipolar disease, depression, schizophrenia, turrets, and much more. Medication and therapy usually help an individual deal with these types of conditions. Sometimes these conditions can make socializing very awkward. People with psychiatric disabilities still remain productive members of society lead normal lives. Cognitive disabilities very greatly and can also be hard to recognize. Most learning disabilities are in this category. Most of the time people with these complications usually have very high intelligence levels, and their trouble comes from communicating, remembering and learning new things. Learning complications come in a variety of forms and make it difficult for people with them to complete school related tasks. These diseases include ADD or attention deficit disorder, ADHD or attention deficit hyper disorder, autism, and much more. Most of the time if special attention is given, children with a learning disability can usually curve it to their advantage. A health related disability is one that can be acquired through out life or one that has existed since birth. Such issues include, epilepsy, diabetes, cancer, and much more. Individuals that have had or have newly acquired a disability should contact local governments for guidance on what steps to take to protect themselves and gain benefits. Researching organizations that are geared toward helping with disabilities or joining groups that provide social, and personal support is recommend as a way to cope. Living with an unfortunate condition does not have to make a person “different” or dysfunctional in society. It can instead make them unique and strong for having to find alternative ways to live in a world geared toward the very few people that are considered “normal”.

Groups and organizations play a huge part in organizing, supporting, and initiating changes in the United States. Organizations or associations also act as support services for alcoholics, drug addicts, other addicts, disorders, diseases, viruses, and disabilities. In America there exists support systems like these for everyone that has an interest in something, has a goal to achieve, or is suffering from some type of life altering circumstance. Blind people are no exception to this rule, and are people that need perhaps the most support for their condition. Blind associations all across the country are organizations that work toward supporting the blind. These organizations differ from state to state and are usually non profit based. There are also some associations that are national based and reach out to a wider range of individuals. An association for the blind provides support and assistance to the blind and their families. Sometimes family members need to join these blind associations to show support for their blind family member, and to learn a little bit more on how to handle living with the blind. An association for the blind offers better access to government benefits, and may offer some monetary funds of their own. These associations are instrumental in lobbying for blind individuals in local, state, and national governments.

The American Association for blind people provides newsletters for its members that includes current news articles relating to blindness and the rest of the disability community. They also offer a directory of technology and product services both new and old, that can assist blind people in everyday activities.

Another national association for the blind is the National Association for parents of the Visually Impaired. This association is unique in that it first non profit, and its run by and for parents. This is important because parents that may not be blind, may not know how to take care of a child that is. This program provides support and services to the parents of blind children.

Some other blind associations that work on a national level include, the Foundation Fighting Blindness, the American Council of the Blind, and the National Federation of the Blind. All of these blind associations have been around for more than thirty years. They all aim to support blind individuals and their families. These blind associations are most useful because they all connect there members to thousands of other people with the same disability, and to other organizations that may be private or state level programs. An association for the blind doesn’t have to just be limited to a support based group, or a group that provides outlets for care. An association for the blind can be a fun, social based association as well. For example, the American blind bowling association, aims to provide a social outlet where the blind, along with family and friends, can have a good time and take their minds of their disability. The development of special guard rails has made this possible for the organization to provide. These blind organizations need to be praised for provide assistance, hope and guidance for the blind. Many times these organizations bring back a sense of life for people with this disability.

In order to determine which people may need special assistance because of their visual disabilities, various governmental jurisdictions have formulated more complex definitions referred to as legal blindness. In North America and most of Europe, legal blindness is defined as vision of of twenty over two hundred or less in the better eye with best correction possible. This means that a legally blind individual would have to stand twenty feet from an object to see it, with corrective lenses, with the same degree of clarity as a normally sighted person could from two hundred feet. In many areas, people with average vision who nonetheless have a visual field of less than twenty degrees, when the norm is one hundred and eighty degrees, they are classified as being legally blind. Approximately ten percent of those deemed legally blind, by any measure, have no vision. The rest have some vision, from light perception alone to relatively good vision. A confirmation of legal blindness from an eye doctor is needed in order for a person to receive aid from the government, tax exemptions from the IRS, and social security benefits. This from can be found on any state, local, or national government website. This form is important because many organizations offer assistance to those that are legally blind. Although each countries guidelines differ, they each have set services and rights that are offered to those that suffer from legal blindness.

The social security disability program, and the supplement security income programs are two ways the United States offers benefits to the blind. The medical rules used to determine blindness are the same for both programs, but other rules are different. If a person happens to just have extremely bad vision, but is not qualifying for legal blindness, than that individual may still apply for social security benefits and help. This usually will be successful if vision problems are keeping a person from earning a living. People that are considered legally blind often make decisions that may place them in harms way.

For example, crossing the street, cooking, cleaning, and doing other personal things. May times normal everyday tasks are affected when a persons vision starts to go. The government has set up schools that will help people that are legally blind and may have no idea how to function properly. These schools may be paid for based on income or waved if a person is relying on government assistance. These programs are usually non- profit based and can be found throughout most communities across the country. Many people that suffer from legal blindness can still lead a normal life, and do not have to give up everything because of it. Many of them first need to overcome the fear of getting hurt or messing up. Second they need to find state rehab programs that cater to this disease, and include family in the process. These programs, along with substantial support from family and friends can get people through a difficult process such as this.
